ZONING MAP AMENDMENTS

  1. Ordinance No. 276-12(Ward 3/Councilmember Cimperman): Changing the Use District of land located on Merwin Street west of Columbus Road from a General Industry District to an Open Space and Recreation District.

  2. Ordinance No. 573-12(Ward 6/Councilmember Mitchell): Changing the Use and Area Districts of lands located on the southwest corner of Union Avenue and E. 117th Street to a General Retail Business District and a ‘C’ Area District.

  3. Ordinance No. 743-10(Ward 8/Councilmember J. Johnson): Amendments requested by Councilmember Johnson for legislation Changing the Use, Area and Height Districts of lands located on the north side of Superior Avenue between E. 101 St. and E. 103 St. to a Multi-Family Residential District, a ‘D’ Area District and a ‘2’ Height District.

MANDATORY REFERRAL

  1. Ordinance No. 663-12(Ward 3/Councilmember Cimperman): Authorizing the Director of Capital Projects to enter into an agreement with FED Main Street, LLC to accept the donation of design plans and specifications necessary to make the improvements to the Flats Eastbank Roadway; determining the method of making the public improvement of improving the roadway; authorizing the Director to enter into one or more public improvement contracts for the making of the improvement; authorizing the Director to accept cash contributions from public and private entities, NEORSD, and GCRTA for costs associated with the improvement and to enter into agreements; authorizing the Director to enter into agreements with private utility companies to pay charges for the installation of underground lines; and authorizing the Commissioner of Purchases and Supplies to acquire for right-of-way purposes real property necessary to make the public improvement.

  2. Ordinance No. 744-12(Ward 3/Councilmember Cimperman): Determining the method of making the public improvement of constructing a transient marina at the East 9th Street pier and associated support facilities and amenities; authorizing the Director of Port Control to enter into one or more contracts for the making of the improvement; authorizing design services, construction management and other related services; acquiring any real property and easements necessary for right-of-way purposes; to enter into various written standard purchase and requirement contracts; authorizing one or more professional consultants for marina management services; authorizing submerged land leases; authorizing the Director to apply for and accept gifts, grants, and other funding from public and private entities, including the gift or loan of equipment; authorizing the Director to fix and charge docking fees; for a period of five years with one five-year option to renew, exercisable through additional legislative authority.

  3. Resolution No. 751-12(Ward 12/Councilmember Brancatelli): Declaring the necessity and intention to appropriate temporary and permanent easements for public use in connection with improving the intersection of Ackley Road and Broadway Avenue at Union Avenue.

  4. Ordinance No. 672-12(Citywide): To amend Sections 431.03, 431.08, 431.10, and 451.07 of the Codified Ordinances of Cleveland, Ohio, 1976, as enacted by Ordinance No. 1684-76, passed June 29, 1976, Section 451.03, as enacted by Ordinance No. 2468-83, passed June 11, 1984, and Section 403.99, as amended by Ordinance No. 486-04, passed October 11, 2004, relating to bicycle transportation safety and penalties; to repeal codified ordinance Sections 473.11, Licensing Bicycles; Fee and Transfer 473.12, Licensing Agents, as enacted by Ordinance No. 2393-02, passed February 3, 2003.

ADMINISTRATIVE APPROVAL

  1. Ordinance No. 654-12(Ward 6/Councilmember Mitchell): Authorizing the Director of Capital Projects to issue a permit to The Cleveland Clinic Foundation to encroach into the public right-of-way of East 105th Street by installing, using, and maintaining an electrical duct bank.  

  2. Ordinance No. 755-12(Citywide): Authorizing the Director of Community Development to enter into a Municipal Agency Agreement with the Cuyahoga County Land Reutilization Corporation (CCLRC) to designate the CCLRC as the City’s agent in order to acquire certain non-productive land within the City of Cleveland upon which there are buildings or other structures and to remove or demolish such buildings or other structures and to transfer ownership of the vacant, non-productive land to the City Land Reutilization Program, together with the rights and privileges granted under Revised Code Section 5722 and with respect to tax exemption under Revised Code Section 5722.11, all in accordance with the Municipal Agency Agreement and the procedures set forth in Revised Code Sections 5722.02 through 5722.15, inclusive, regarding the reutilization of nonproductive lands within the City of Cleveland.
  3. Ordinance No. 746-12(Ward 18/Councilmember Sweeney): Determining the method of making the public improvement of rehabilitating the South Cargo Ramp and reconstructing Taxiway N at Cleveland Hopkins International Airport; authorizing the Director of Port Control to enter into one or more contracts for the making of the improvement; authorizing professional design services, construction management and other related services; and to enter into various requirement contracts needed to implement the improvement.
  4. Ordinance No. 732-12(Ward 4/Councilmember K. Johnson and Ward 6/Councilmember Mitchell): To amend the title and Section 1 of Ordinance No. 591-11, passed June 6, 2011, relating to the rehabilitation of Woodland Avenue, Phase 1, to include the resurfacing of Buckeye Road from Woodland Avenue to Ambler Avenue.
  5. Ordinance No. 733-12(Ward 19/Councilmember Keane): To amend the title [and] Sections 1 and 9 of Ordinance No. 912-11, passed August 17, 2011, relating to the rehabilitation of Triskett Avenue, Phases 1 and 2 to include asphalt resurfacing on Warren Road from Munn Road to Lorain Avenue.
  6. Ordinance No. 739-12(Ward 1/Councilmember Pruitt): Determining the method of making the public improvement of constructing the East 176th Street area sewer replacement, which may include but not be limited to installing manholes and catch basins, and authorizing the Director of Public Utilities to enter into one or more public improvement contracts for the making of the improvement.
  7. Ordinance No. 741-12(Ward 15/Councilmember Zone): Determining the method of making the public improvement of constructing the Wakefield Avenue area sewer replacement, which may include but not be limited to installing manholes and catch basins, and authorizing the Director of Public Utilities to enter into one or more public improvement contracts for the making of the improvement.
  8. Ordinance No. xxx-12(Ward 18/Councilmember Sweeney): Authorizing the Director of Port Control to enter into and execute agreements and such other documents as may be appropriate to sell .24 acres of City-owned property located north of Springdale Avenue to Cleveland Business Park, Ltd. for no less than the appraised value of Ten Thousand Five Hundred Dollars ($10,500), as the property is no longer needed for public use.
  9. Ordinance No. xxx-12(Ward 18/Councilmember Sweeney): Authorizing the Director of Port Control to enter into requirement contract(s), design/build contracts, and professional service contracts necessary to design and construct the Cleveland Hopkins Terminal Boiler Replacement Improvements and related facilities to meet current needs.
  10. Ordinance No. 740-12(Ward 3/Councilmember Cimperman): Determining the method of making the public improvement of constructing the St. Clair Avenue area sewer replacement, which may include but not be limited to installing manholes and catch basins, and authorizing the Director of Public Utilities to enter into one or more public improvement contracts for the making of the improvement.
